Data Protection Declaration

Careful and legally compliant handling of your personal data and information is an important matter for us. We carry out our online services solely in accordance with the respective valid and applicable legal provisions for the protection of personal data. With this data protection declaration we would like to inform you about the extent of data use and processing when you visit our Banananights homepage/ app (“online service”).

(1) Is my data stored?

When you visit our online service for the purposes of system security, our server temporarily records the domain name or the IP address of the enquiring computer as well as the access date, the file enquiry of the client (file name and URL), the HTTP answer code and the website from which you are visiting us as well as the number of bytes transmitted in the course of the connection. If necessary, some information is stored on your computer in the form of so-called "cookies" to enable us to optimise our website according to your preferences (see further information under section (5) "Cookies" below).

Additional personal data, such as name, address, telephone number or email address, is not recorded unless these details are volunteered by you, e.g. within the scope of an order. We have to store, process and utilise certain data to be able to execute all orders in line with your wishes. These are initially your address details or other data which is necessary for certain payment methods. The respective order data (item, quantity, price, etc.) is also assigned to your address types in the course of your order. We store and utilise the data to manage the concluded contractual relationship and to further cultivate the customer relationship.

To protect your data against unauthorised access during internet transmission, we use SSL, one of the safest encryption methods currently available.

(2) Your rights

Under the German Federal Data Protection Act (BDSG), you have a right to free information regarding your stored data and, if applicable, a right to the correction, blocking or deletion of this data.

You have the right to object to the storage of your data at any time with effect for the future – this especially applies to the use of Google Analytics (see (3) below) and cookies (see (5) below) – or to revoke consent that has once been granted (e.g. with regard to the forwarding of the newsletter pursuant to (6)) at any time with effect for the future. Your objection or revocation does not include data, the deletion of which conflicts with the statutory or contractual storage periods, and data which is necessary for the establishment, content-related design or amendment of your contractual relationship with us or which has to be stored for billing purposes. (3) Google Analytics

Our online services use Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses cookies which allow an analysis of the use of our online offer by you. The information generated by the cookie about your use of our online offer is generally transmitted to a Google server in the USA and stored there. If IP anonymisation is activated on this website, your IP address will however be truncated by Google beforehand within member states of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to a Google server in the USA and truncated. Google will use this information on behalf of the operator of this website for the purpose of evaluating how you use the website, compiling reports on website activities and providing further services related to website and internet usage to the website operator. The IP address transferred by your browser within the scope of Google Analytics will not be associated with any other data held by Google. You can prevent the storage of cookies by selecting the appropriate settings of your browser software. However, we would like to point out that if you do so, it may not be possible for you to make use of the full scope of all this website's functions. (4) Facebook social plug-ins

To make our online services a more personal experience, we use Facebook social plug-ins, operated by the US company Facebook Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA). The plug-ins are recognisable by one of the Facebook logos (white “f” symbol on a blue background or a "Thumbs up" symbol) or bear the "Facebook social plug-in" suffix. The list and appearance of the Facebook social plug-ins can be viewed here: http://developers.facebook.com/plugins . When you access a page of our online services that contains one of these plug-ins, your browser establishes a direct connection with the Facebook servers. Facebook sends the plug-in content directly to your browser, which then integrates this into the web page. As a result, we have no control over the amount of data that Facebook collects using this plug-in and therefore inform you to the best of our knowledge.

By integrating the plug-ins, Facebook is notified that you have opened the corresponding page of our online services. If you are logged into Facebook, Facebook can assign your visit to your Facebook account. If you interact with the plug-ins, e.g. press the Like button or submit a comment, your browser sends the corresponding information directly to Facebook and saves it there. Even if you are not a member of Facebook, Facebook can still record your IP address and save it. If you are a member of Facebook and do not want Facebook to collect data about you via our online services and link it with your membership data stored at Facebook, you must log out of Facebook before visiting our online services. Facebook social plug-ins can also be blocked with add-ons for your browser, e.g. with the "Facebook Blocker".

(5) Cookies

Cookies are specific identification marks which we transfer to your computer’s hard drive or other end-user devices so that our systems can recognise your device. Cookies have the advantage that you can use many of our offers. If you do not approve the use of cookies or refuse to accept cookies by other means, it is, for example, not possible to use several products or services that require you to log in. The help function of most web browsers will explain to you how to prevent your browser from accepting new cookies, how to instruct your browser to inform you whenever you receive a new cookie or how you disable all received cookies.

(6) Newsletter

Information that we receive from you helps us to permanently improve our online services and make it customer-friendly and individual. The information you supply and which is automatically generated for the dispatch of the newsletter is used in a personalised form to design and send you individual advertising that is tailored to you and your interests. For this, we use information such as delivery and read receipts of emails or what links concerning what specific areas of interest you clicked on in the newsletters. We also compare, for example, which of our advertising emails you open to prevent you receiving unnecessary emails from us. Therefore, ultimately you are sent advertising such as the newsletter or product recommendations by email or mail advertising that correspond to your fields of interest and might therefore actually interest you.

By confirming your subscription to our newsletter you consent to us using the data you supply and any other information stored on your customer account as well as your user data to present personalised advertising and/or special offers and services to you.

(7) Is my personal data forwarded to third parties?

To be able to offer you the most optimal options for the choice of payment method and to rule out any difficulties with payment transactions, we protect you and ourselves from misuse. If we pay in advance, for example, in the case of a purchase on account, we reserve the right, in order to safeguard our legitimate interests, to obtain a credit report on the basis of mathematical and statistical methods from Schufa Holding AG, Kormoranweg 5, 65201 Wiesbaden ("Schufa"). For this purpose, we send the personal data required for a credit check to Schufa and use the information we receive on the statistical probability of a shortfall in payment to make a balanced decision on the establishment, execution or termination of the contractual relationship. The credit report may contain probability values (score values) which are calculated on the basis of scientifically recognised mathematical and statistical methods and also include address data. Your data protection requirements will be considered according to the statutory provisions.

(8) YouTube videos

The embedded YouTube videos are used by YouTube within the framework of admissible usage which all users are obliged to accept. If you regard copyrights as being infringed, please report this directly to YouTube. We use embedded YouTube videos in advanced data protection mode, i.e. YouTube does not save cookies for a user opening a website with an embedded YouTube video player if he does not click the video to start it. Once the YouTube video-player is clicked, YouTube may save cookies on the user's computer but no personal cookie information is saved for playing embedded videos (source: YouTube "Activate the advanced data protection mode for embedded videos").

The contents (texts, graphics, logos) of these web pages are protected by copyright. The copyright stays with the respective author or licensee. The processing, reproduction, dissemination or other utilisation require written approval by the respective author or originator.
